13 May Bringing Employees Back to Work: EEOC Guidance on Accommodation
As we continue to focus on employer/employee relationships and bringing people back work, this is good time to talk about the Equal Employment Opportunity Commission (EEOC), the Interactive Process, and what kinds of conversations employers should be having with their employees who may need accommodations for COVID-19 related reasons.
Here are some useful resources:
- EEOC Questions & Answers
- Job Accommodation Network (General)
- Job Accommodation Network (COVID Specific)
- Job Accommodation Network handy practical guide for the interactive process and accommodations.
I know not every employer is a covered entity under the Americans with Disabilities Act, this is one of those times when not acting like a jerk and hiding behind a (valid) legality is probably better in the long run. Employees have long memories and lots of friends. Don’t be on the wrong side of bad PR.
If you have questions, please contact us or other qualified counsel.
If you want to talk through some of those ideas, let’s schedule a time to chat. If you want to schedule a 15 minute call with me, go to my online scheduler (Note: For those of you who are not clients, the call will include a $50 fee. Clients will be billed the lesser of $50 or according to your fee agreement).
