14 Aug The Latest Lawsuit You Should Know About
A federal judge in New York City issued a ruling in a lawsuit between the State of New York and the U.S. Department of Labor (DOL) regarding the Families First Coronavirus Response Act (FFCRA). One issue in the case is whether the DOL exceeded its legislative authority about who is eligible for FFCRA leave.
The big potential issue for small businesses is that the ruling may cause the DOL to amend its regulations. The result is that employers may have to provide PAID FFCRA leave to furloughed employees. This is a just a warning right now as it only applies to businesses the New York City Metro area (and not even all of that area). But unless the DOL successfully appeals the ruling, the DOL may be forced to amend its regulations with a significant potential hit to employers.
